These terms are an agreement between you and Joshua Taban Armstrong, ABN 50 041 155 776 (“we”, “us”), the operator of the Amongst It app. By creating an account or using the app, you agree to them. Please also read our Privacy Policy, which explains how we handle your information.
1. What Amongst It is
Amongst It helps people find and organise local events and activities. Organisers post events; other people request to join; the organiser decides who is accepted. Once a request is accepted, the organiser and the joiner can see each other’s contact number so they can sort out the details.
We are a platform, not the organiser. Events are run by the people who post them. We do not run, supervise, vet, insure or attend events, and we do not check the identity or background of users. You are responsible for deciding whether an event and the people involved are right for you.
2. Who can use it
- You must be at least 18 years old.
- You must give us accurate information, including your real name and your own mobile number, and keep it up to date.
- You may only have one account, and you must not use someone else’s.
- You must not use Amongst It if we have previously removed you, or if you are prohibited by law from using it.
You are responsible for everything done through your account and for keeping your phone and the email account you sign in with secure. Tell us straight away if you think someone else has accessed it.
3. If you organise an event
- Describe your event honestly — what it is, when and where it is, what it costs if anything, and anything people need to know to take part safely.
- You are responsible for your event, including any permits, venue permissions, insurance, and compliance with the law and with any venue or public-space rules.
- Only use contact details you receive through the app to arrange the event you shared them for. Do not add people to marketing lists, sell to them, or pass their details on.
- If you cannot go ahead, cancel the event in the app as early as you can so accepted joiners are told.
- Amongst It is not a ticketing or payment service. If you ask people to pay anything, that arrangement is between you and them, and you must be clear about it in the event description.
4. If you join an event
- Only request events you intend to attend, and withdraw in the app if your plans change.
- Use an organiser’s contact details only to arrange that event.
- Take sensible precautions, particularly when meeting people you do not know: meet in public places where you can, tell someone where you are going, and leave if you feel unsafe. The location shown before you are accepted is approximate on purpose.
5. Content and behaviour we do not allow
We have no tolerance for objectionable content or abusive users. You must not use Amongst It to post, send or organise anything that:
- harasses, bullies, threatens, stalks or intimidates anyone;
- is hateful or discriminatory on the basis of race, ethnicity, religion, disability, gender, sexual orientation, age or any other protected attribute;
- is sexually explicit, or seeks sexual services;
- involves, targets or is aimed at anyone under 18;
- is violent, promotes self-harm, or encourages dangerous or illegal activity;
- is false or misleading, including fake events, impersonating another person or organisation, or events designed to lure people somewhere;
- is spam, a scam, a pyramid scheme, or unsolicited advertising;
- involves the sale of weapons, drugs or other regulated goods;
- infringes someone else’s intellectual property or privacy.
You also must not:
- collect other users’ information, scrape the service, or try to work out the exact location of an event you have not been accepted to;
- interfere with, overload, reverse-engineer or try to gain unauthorised access to the app or our systems;
- use automated means to create accounts, post events or send requests.
6. Reporting and blocking
You can report any event or user from within the app, and you can block any user. Blocking someone stops them seeing your contact details and stops them seeing or requesting your events. We review reports and aim to act on objectionable content within 48 hours, which may include removing content and removing the person who posted it. If you believe someone is in immediate danger, call 000 first.
7. Removing content and accounts
We may remove or cancel any event, decline to show content, or suspend or close any account, if we reasonably believe it breaches these terms, puts anyone at risk, or exposes us or others to legal liability. Where it is safe and appropriate, we will tell you why.
8. Your content
You own what you post. You give us a non-exclusive, royalty-free, worldwide licence to host, store, display and distribute it for the purpose of operating and promoting Amongst It, including showing events to people through the app and through links you or others share. This licence ends when the content is deleted, except where it has already been shared or we need to keep it for legal or safety reasons.
You confirm you have the right to post what you post, and that it does not break these terms or the law.
9. Our app
The app, its design, and the Amongst It name and logo belong to us or our licensors. You may use the app for your own personal, non-commercial use in line with these terms. Map data © OpenStreetMap contributors.
If you downloaded the app from the Apple App Store, you also agree to Apple’s Licensed Application End User License Agreement, and Apple is not responsible for the app or for supporting it. If these terms conflict with Apple’s or Google’s store terms on a matter those store terms govern, the store terms apply.
10. Availability and changes
Amongst It is provided free of charge. We are working hard to keep it running, but we may change features, or suspend or discontinue the service, and it may sometimes be unavailable or contain errors. Notifications may be delayed or not delivered, so do not rely on the app for anything time-critical or safety-critical.
11. Liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Subject to that:
- we are not responsible for events organised through Amongst It, for what happens at them, or for the acts, omissions or content of any user;
- we are not liable for any indirect or consequential loss, or for any loss of profit, data or opportunity; and
- to the extent we are permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again.
You are responsible for loss caused to us or to others by your breach of these terms or your conduct at an event, to the extent the law allows.
12. Ending your account
You can stop using Amongst It and delete your account at any time from the You tab in the app. Upcoming events you organise are cancelled when you do. Sections 8, 11 and 14 continue to apply after your account ends.
13. Changes to these terms
We may update these terms. If a change materially affects you, we will tell you in the app before it takes effect. If you keep using Amongst It after that, the updated terms apply; if you do not agree, you can delete your account.
14. Governing law
These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of its courts.
